Rules and responsibilities for using the Mboa platform

Welcome To Mboa

Mboa is designed to make fundraising simple, transparent, and secure. Whether you're an NGO looking to create campaigns or a donor eager to support meaningful causes, Mboa provides the tools and guidance you need.

1) Acceptance

By creating an account, visiting the site, or using the services, you agree to these Terms and to all incorporated policies (including the Privacy Policy). If you do not agree, do not use the services.

2. Eligibility

  • You must be at least 18 and able to form a contract.
  • If you register or act on behalf of an NGO/organization, you confirm you have authority to bind that entity.

3) Accounts and Security

  • Keep your credentials confidential; you are responsible for activity under your account.
  • Promptly notify us of any unauthorized use or security incident.
  • We may suspend or terminate accounts for violations of these Terms or misuse.

4) Platform Role

Mboa connects NGOs ("Organizers") with donors. We are not a charity, fiduciary, or financial institution. We do not guarantee that campaigns will meet targets or that funds will be used for a particular purpose. Disputes between Organizers and donors must be resolved by those parties.

5) Donations and Payments

  • Payments are processed by third-party providers; their terms apply.
  • Fees (processing and platform fee) may be deducted from donations; exact fees are shown at checkout or in your dashboard.
  • Currency and Conversions are handled by the payment provider.
  • Refunds are not guaranteed; any refund is at the discretion of the Organizer or as required by law/payment provider rules.

6) Organizer Obligations

  • You must provide accurate campaign information and use funds as described.
  • You are responsible for required licenses, registrations, disclosures, tax filings, and compliance with fundraising laws.
  • You must promptly address donor inquiries and legal requests related to your campaigns.

7) Donor Disclosures

  • Donations may be made under your display name or anonymously (where available). Public proximity hides your name from public pages and other donors; organization admins may see your identity only if you consent to organizer visibility. Platform admins may access donor details for compliance/fraud/refunds.
  • Receipts are issued by the platform/payment provider; they may not be tax-deductible. Consult your tax advisor.

8) Prohibited Conduct

You may not use the services for, or in connection with: illegal activities; fraud or misrepresentation; money laundering or sanctions violations; exploitation or harm to minors; hate, harassment, or violence; malware or security attacks; scraping or reverse engineering; or any use that interferes with the platform.

9) Content and IP

  • You retain your content but grant Beron a worldwide, non-exclusive, royalty-free license to host, display, and distribute it to operate the service.
  • You must have rights to the content you post and it must not infringe others' rights.
  • Marks and platform materials of Beron remain our property; no license is granted except as needed to use the services.

10) Privacy

Your use is subject to our Privacy Policy, which explains how we collect, use, and share personal data.

11) Third-Party Services

Links or integrations (e.g., payment processors) are provided "as is"; their terms and policies govern your use of those services.

12) Service Changes

We may update, suspend, or discontinue features at any time. We will try to give notice of material changes when practical.

13) Disclaimers

Services are provided "as is" and "as available". To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free service.

14) Limitation of Liability

To the maximum extent permitted by law, Beron and its affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill. Our aggregate liability arising out of or related to the service will not exceed the greater of (a) USD 100 or (b) the total fees you paid to us in the 3 months preceding the claim.

15) Indemnification

You will defend, indemnify, and hold harmless Beron, its affiliates, and their personnel from claims, damages, losses, and expenses (including reasonable legal fees) arising from your content, your use of the services, your donations or campaigns, or your breach of these Terms.

16) Termination

You may stop using the services at any time. We may suspend or terminate access for violations or risk. Clauses intended to survive (e.g., IP, disclaimers, limits of liability, indemnity) remain in effect.

17) Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction of Beron's principal place of business, without regard to conflict of laws rules. Courts in that venue will have exclusive jurisdiction, unless applicable law requires otherwise. You waive class action and agree to bring claims individually.

18) Changes to These Terms

We may update these Terms. We will post the effective date and, for material changes, provide notice. Continued use after changes means you accept the updated Terms.
